TOXIC MOLD - HELP! - MY AWFUL STORY

I paid this company over $44,000 to treat me like this. My awful story of: Restraining orders, illegal BK, Sanctions, 200+ Subpoenas, Micotoxin exposure, and blood labs. Learn how to protect yourself against false advertising (why I have punitive damages)

They would not fix water leaks - it would take getting really mad to get things fixed, I paid $1,395.00 month in rent. The health problems can continue for years - Mine did not end after I moved out. Victims mention they are dropped right before trial. The dollar return is not enough. Experts are expensive. Find an Attorney with money and one who has gone to trial (key). My first one stated he had never been to trial.

A family I've become close with who have my same documented mold symptoms said:

UPDATE as of February 2005; I'm still in pro-per, broke, and desperatly in need for some funding to fight this...

* Someone impersonated the judges office in an attempt to obtain my high school records in Missouri (when will this stop)...A Subpoena was issued by defendants for the records. However, because of the Privacy Act (FERPA) of 1974 my records were protected. I received a call from the school stating someone called from the judges office and wanted my records released immediately, my school asked the person who stated they were from the judges office for a fax confirmation, the impersonating party said the judge would send a faxed signature, four days later when my school did not received the fax from the judges office they contacted me, I then contacted the judges office, Judges office stated they don't do things like this (contact people directly)..., I called the school back and it all was tape recorded. I filled a Motion to alert the Judge.

* Now it is 200+ subpoena's, some of my Doctors whom previously stated they did not have records continue to be subpoenaed.

* I won the Quash against the Defendants (story below) for my ATT/Cingular cell phone records. Defendants pulled it back and was moot. If I had not fought the subpoena and filled a Motion they would have had all my phone records for the past 8 years which included Secret Service cell phone numbers....

* Friends are gladly attending depositions and stating how I looked "jaundice with purple shiners"....I go to each one and ask questions at the end.

UPDATE as of March 2005

* I would like to thank people for their support. It's helped tremendously. However, it doesn't look like I can keep fighting. Defendants have 8 experts, three law firms and I attended over 20 depositions taken of friends and Dr's the last Month...with more coming...I am to have trial in June...

* Right now I am waiting for all my friends and doctor deposition transcripts to come in after their corrections. I attended all depositions and asked questions at the end (I do think I shocked the defense attorneys though :).

* I need to obtain copies of the depos to protect myself from defendants possible retaliation; trying to save for the copies at $2.75 / page, over 2000 pages; I was quoted through the defendants hired deposition service.

* An Attorney mentioned I will need these copies of certified depo transcripts should the defendants decide to come back and sue me. I think they will...after you read below regarding what they have already done to me. All my friends depos were proof I did suffer health problems with the mold...

I paid $1,035.00 per month when I moved in February 1998 and was paying $1,395.00 per month in June 2001, when Irvine Apartment Communities (IAC) personally hired and paid movers to move me because of their neglect. I had $70,000.00 dollars in the bank at this time, stocks and IRA. I wanted to move back to the mid-west and buy my first house. Previously started a business, flat broke, in a garage studio apartment after taking care of my Grandfather in his last years. He was my best friend. To my Grandpa & Grandma, George and Dorothy Hicks: Thank you for your time, knowledge, kindness, sense of humor and for raising me with so much un-conditional love...it's because of you I have been able to withstand this...

My last Attorney wrote a letter. He stated he had health problems and had to withdrawal from the case. I have not found another Attorney. After all I have been through (below), and fighting in pro-per again. He mentions:

I have found your cooperation and attitude in working with my firm exemplary. I have always found you punctual and willing to engage when asked. I hope you can find another firm to help you pursue this matter, as I believe you have been damaged.

There was a previous mold Attorney on my case. I do not owe this Attorney any money. I was put through Bankruptcy and my case was not claimed as an asset. I was stuck in pro-per and left to fix this myself for (7) months. A settlement letter was sent to this mold Attorney who had my bankruptcy papers, from Western National Property Management, the 3rd Defendant (not Irvine Company) which Stated:

Dated: January 27, 2004

I am interested in discussing a potential settlement of the case as between our respective clients. To that end, please forward a reasonable settlement demand for consideration by my client and principal.

I could not have legally accepted a settlement at this time, I found I could have gone to prison for 5 years. The Attorney tried to get me to accept. Sent me mean E-mails and yelled at me. At the time the settlement letter was sent he was in the process of dropping my case a month before trial anyway. I felt something was really fishy by his actions, his personality did a 180. While I was looking for another Attorney, I was told at that time my case was owned by the "Bankruptcy Trustee" and I could have gone to prison up to 5 years if I had taken the money...

This attorney did not provide me with a Retainer Agreement, did not attend the defenses depositions of my Dr's stating in a letter: these "Dr's were not important". However, he did not have my medical records from these doctors. All my depositions were cancelled during his representation. A paralegal mentioned this is like your Attorney not showing up for trial.

I made him go to court to be released. He tried to get me to sign and agreement that I would pay him costs as he was bulling me to dismiss him and give him a settlement offer. I would not. It was not our verbal agreement for me to pay costs. I would have never been able to do this.

COVER YOUR BUNS - While still a tenant...

  • Call the Health Department, should you get no action from Apartment Management. Mention Water Intrusion, they don't acknowledge mold. May take several calls to get action.
  • Document, document, document, before you are relocated so fast you don't know what hit you.
  • Make sure you get your own environmental report, before relocating. Wet molds; inside wall cavities, foundation leaks, under bath flooring leaks, may not be detected with environmental air samples; check inside walls for wet molds causing micotoxins and take samples. Check padding and keep samples in Baggies.
  • Before they come to test, have your apartment closed up for 24 hours, run the ventilation systems and do not take a shower which may prevent the mold from becoming air born an unable to get an accurate air sample.
  • Video tape the testing, take pictures.
  • Think twice before they have you sign the contract titled 'Moving Release' with the words 'water intrusion' in it. I think this would be considered fraud?
  • Make sure they don't relocate you to another toxic mold apartment.
  • Yes, they can find toxic mold in your blood; Micotoxins. Regular Dr's say otherwise.
  • Ask "Forensic Toxic Mold Doctor Experts" for advice. Or, I found good Attorneys use certain Dr. experts they like who are good at trial. LA Attorneys seemed more helpful to me.
  • ANY TIME! a doctor takes blood or does testing get copies faxed to you and keep them always ! Then when you go to another Dr. you have everything. My blood counts had dropped for 2 + years and no Doctor told me. When I went back and picked up all my blood labs for 3 years at the various doctors, I inquired about why I was not told; They said I was "not cancer yet".
  • Just because someone is a Doctor or Lawyer does not mean they are good at what they do, ethical, or have your best interest over money in mind. I did not have a lot of experience with health problems etc. Took me a while to get this.
  • A Medical Malpractice Attorney mentioned to get all your records before professionals find out your in a law suite or plan on suing. Therefor, nothing can be changed later. They already know you have copies. I asked how often this went on, his exact words were, as he looked at me sharply, "a lot".

ADVERTISING DOESN'T CORRESPOND WITH IAC ACTIONS

This is why I have punitive damages allowed in my complaint.

The tenant prior to me was a VP of IT. He stated he put in (2) work orders to have water leaks fixed, they were never acknowledged. I had foundation, water intrusion problems from the very first day I moved in which were not acknowledged...and their advertised flyers I still have from my tenancy state:

"Higher Standard of Living, Rancho San Joaquin Apartments." Claiming: "We take pride in the quality of our community and the service we provide"..."Our professional staff is experienced and well trained"..."These factors, along with our lovely apartments, beautiful landscaping, and warm hospitality help make RANCHO SAN JOAQUIN not just a unique place to live, but a home to enjoy"..."Welcome and best wishes in your new home"...

DEFENSE's SUBPEANA PROCESS and THEY THREATENED MY FRIEND.

They would not have been able to get away with this if I had an Attorney.

Recently, I was served with 67 Subpoenas by one of the Defense Attorneys, Ms. Bonnie Lutz of Klinedinst Law Firm, this past Christmas eve 2004. I am in pro-per - I am trying to quash them on my own; my phone records consist of important people.

Previously, Defense sent out 56 Subpoenas to all my doctors and some of the same people stated they did not have any records.

Some of the parties recently subpoenaed I've never had contact with ever in my life. These individuals are upset their lives are being disrupted and they are being harassed. One person called the law firm and wants and apology letter from Ms. Bonnie Lutz and Klinedinst. Ms. Bonnie Lutz of Klinedinst sent out my full social security number, date of birth and full name on these subpoenas, to individuals I don't know. The subpoenas are unlimited to time and not signed. If that means anything.

All my cell phone records from unlimited years were subpoenaed. These numbers will include incoming and out going private cell phone numbers and direct lines of a Director of the Secret Service, private number of an Head Executive of a major airport, Executives private cell numbers I did business with. Many of them high level. Along with people who were confidentially looking for jobs, calls to and from my attorney to be client/attorney privilege.

All these individuals rights to privacy and privilege are going to be invaded. They wont know it until the defense starts to harass them. Like the above people subpoenaed; who I don't know and who have already been sent subpoenas. People I spoke to regarding charity events or jobs may not know who I am now and will be harassed..

Isn't there a Protection Code under ARTICLE 1, SECTION 1, OF THE CALIFORNIA CONSTITUTION against acts like this. Aren't they to be professional Officers of the Court?

Ms. Lutz recently threatened someone I have a great deal of respect for. She was scared to death. Ms. Lutz subpoenaed her for a deposition under the complete wrong name. I thought they were officers of the court and to do their job with respect and honesty. I filled a motion to be heard on February 3, 2005 and to have this women served properly for the deposition. She stated; Ms. Lutz threatened her with a Marshall that will come to her office if she did not attend. She is a highly respected business owner in Newport Beach. Ms. Lutz did want to abide by the fact that a Motion was filled and this person was to be served under the correct legal name.

Now, I have had enough! This is when I decided to post it all. When they threaten, harass, good, kind hearted, hard working people because they don't want to take the time to do their jobs properly or the Irvine Company does not want to fix maintenance issues, that is when I draw the line. I wish I knew how to sanction them as you will read below!

RESTRAINING ORDER - They Tried

After trying desperately to obtain a restraining order against me which stated: you ARE HEREBY RESTRAINED AND ENJOINED from:

Their #5 stated; Entering the offices of defendants' attorneys herein.

Ms. Bonnie Lutz of Klinedenst law firm then demanded, to the judge, all my depositions be taken on the Klinedinst law firm site to accommodate her...

If you were afraid of someone desperately enough to try and obtain a restraining order against them... would you then demand, to a judge, they come to your office ? Even if the person being accused won against the temporary restraining order...?

Do you think this was all just to harass me in to dropping my case and they never, ever, thought I was actually a threat to them?

And in addition, Ms. Burden and Ms. Lutz wanted to take pictures of me and distribute it to all the Irvine Company properties. "Because, not all of the defendants would know what I looked like."

I live in constant fear for their next tactic.

Previously (pro-per state twice), All the Defense came at me while I was in pro-per and trying to fix my bankruptcy. They sent me file boxes of Sanctions, Motions and a Restraining order - and I won.

This is when I learned what a 'Pleading' was and how to do "Motions" while in pro-per. In addition when and how to file the Motions with the courts and serve them properly. It took day and night for weeks.

In addition, Defense Attorneys tried to get rid of my punitive damages by attending a court hearing, I did not know about. They were unsuccessful.

Ms. Linda Burden of Smith and Susson Law Firm and Ms. Bonnie Lutz of Klinedinst Law Firm tried to get a restraining order against me - I fought and won by doing my own pleading and motion. Conveniently, Defense stated the restraining order was only for the duration of the case. I was devastated and did not sleep. This seemed highly wrong to me. However, very convenient way for them to get me to dismiss my case. I doubt they thought I would fight them.

They wanted to take a picture of me and distribute it to all the Irvine Company properties. Thank God the Judge would not allow them to do this. I paid this company a lot of many to treat me like this.

Defense Attorneys said I called them "scum" while leaving a courtroom. I was with 2 people I new sitting on the bench as the defense walked by. Defense tried to say I said it in a way I did not - "agitatedly". There was a reason I did this and meant their tactics are scum, because of what they said during the court hearing, I believed they lied to the judge. I said; "I felt sorry for Irvine company employees, the mold problems seem to be extensive and they have to put up with angry tenants because of cheep building materials and IAC Executive politics." However, Ms. Lutz accused me of saying something else and turned it all around.

Employers consider a restraining order an act of violence. It would prevent me from obtaining employment with a larger corporation whom performs background checks. If they were able to obtain the restraining order, I would have had to drop my case so not to loose my career.

HOW I FOUGHT THE RESTRAINING ORDER

Seems like I called every Attorney in the Nation to find out how to fight a restraining order; almost all Attorneys said you can't. You can find Attorneys on 'Martindale.com'. However, be careful most seem to be Defense attorneys. Some I told my story to and then when finished, said it would be a conflict of interest. The Attorney got me to tell my story and them most likely contacted the defense (I'm not use to these kinds people). I found a guy in Utah who told me how a client of his fought and won on his own. I did the exact same thing. I got letters from long term friends and people I did business with on my character with each letter notarized, showed pictures of how I use to be...filed a motion with all the exhibits on the numbered paper, and I beat all three law firms.

People I knew came out to help me and attend court hearings while I was in pro-per that time. I could have never done it alone; I was a wreck.

DEFENSE came at me with $1000s of sanctions

If I had an Attorney I doubt they would have done this. It's a full time job for someone in pro-per with out a law degree. Also, trying to fix the bad Attorneys bankruptcy which took (7) months. I was just able to get back to work after 2 years off from mold sickness. Then could not mentally or physically work because I had to take care of all this in pro-per. I ended up (after this) not being able to pay rent, evicted and my car was reposed.

Ms. Lutz tried to Sanction me with $1000s, a complete file box of paperwork and quashing subpoena's. I was stuck in pro-per while cleaning up the bankruptcy. An Attorney could not help me with my case, it was owned by the Bankruptcy Trustee and Attorney at this time. I was told I had to keep going with my case on my own because there was a trial date set. I was left up to any Attorney who would try to help me and kept using 'Martindale.com' They did not get any sanctions against me for this. I won again.

Again, an Attorney could not take my case because legally I did not own it.

I was sent me to (2) IME, Independent Medical Examination appointments to UCLA over 60 miles away at the wrong times, by the Defense. The 3rd time my car broke down with a radiator hole on the way there. I had it replaced and showed the Judge in a motion the invoice because they tried to come at me again with more sanctions. I won.

The 4th IME time (your not going to believe this one) Ms. Lutz tried to sanction me again for $2,376.30 on 12/22/05. Stating something to the effect; I did not shake the Dr.'s hand and I faked my pulmonary test. I was diagnosed with bronchial asthma since I was in the toxic mold apartment. I guess they don't get it. I drove 60 miles, 3 hours in traffic to get to UCLA. I was left to sit in the waiting by their Doctor for 45 minutes, pretty beat by then. I did not feel like shaking the Doctors hand. I had no idea that was against the law. I am pretty sure after dealing with this mess there are definitely good people in prison who should not be there.

I guess the Defense needs more billing money. The motion they filled on 12.22.05 stating:

  1. Defendants are allowed to disclose to the jury Plaintiff ____ refusal to comply with Defendants demands for Independent Medical Examination.
  2. Monetary sanctions be imposed and Plaintiff ____ is required to pay sanctions to compensate Defendants for the costs and fees incurred n bringing this Motion in the amount of $2,376.30 in a cashiers check made payable to Klindenst PC with in seven (7) days.
  3. Issue sanctions be imposed and Plaintiff ____ is prohibited from supporting the claim that there were elevated levels of air born mold spores in her leased apartment that caused personal injury; and
  4. Evidence sanctions be imposed and Plaintiff ____ is prohibited from introducing any evidence of personal injury or medical expenses due to mold exposure; and
  5. Terminating sanctions be imposed and the entire action is hereby dismissed.

appears to be declined because I received it with a big X through it. With a hand written note above the judge stamp: to Attend IME (5th time) on 1/31/05 at 2:30 UCLA and relate medical history, symptoms and complaints. However, I have to go alone again, unprotected, and I truly believe they will come up with something else to throw at me. I can't please these people even when I cooperate. I am obviously a sitting duck alone.

After file boxes of sanctions for $1000s Ms. Lutz of Klinedinst tried...showing several hours of billing time, the judge only applied $500.00 (this is all I owe to date). This was for the day I physically could not go to a deposition alone. Attorneys would not help me because they said the Trustee Attorney had an obligation to go with me and they could not legally go with me. This was also right after the Defense tried to get a restraining order on me. I was truly scared to death to be alone in a room with them and throwing up the days before the deposition, then cancelled at the last minutes from terrible fear.

AFTER MY CASE WAS RELEASED BACK TO ME from the BK Trustee.

I found a new attorney who took me on, right away after he saw what I did.

I immediately got back to work. I had to start paying some friends who helped me get my car out of repossession and have money to eat etc...

The Attorney found out about his health problems. He was cool. He was street smart, not just book smart and we thought the same way. I thought I was finally moving forward. I thought he looked really skinny when we met. I was able to get back to work for a little while...until now back in pro-per again. After I released him, I lost this last job to stress and what I'm dealing with now in - pro-per.

This last deposition (Volume II) on Dec 8, 2004, I had to go by myself. When I was with my Attorney who is sick, I was OK. After 3.5 hours in to this deposition I wanted to go. I felt sick to my stomach. I was threatened by Ms. Lutz with more sanctions and that I would have to come back the next day. Day after day is how they want you to do it until they are done with me. I have to go from 10a - when ever they decide to release me. Ms Lutz of Klinedinst then verbally badgered me. All on tape. It's hard to be there alone with 3 law firms and no protection. It's scary.

I have Volume III deposition in January 2005, all by myself. Totally unprotected against these people. I live in constant fear of what they will do to me next.

HEALTH INSURANCE COSTS. FURNITURE COSTS.

The health insurance companies obviously pay for the neglect of poorly maintained apartment housing. My Blue Cross has put out about $48,000.00 just to date. I have about $45,000.00 out of pocket health expenses. Furniture, clothing, (I have copies of all receipts) estimate to $100,000.00 everything bought new when I first moved in. New clothes came to 40K, Shoes, purses, and luggage 9K. (have all receipts) New cars as well.

My Grandfathers full set of 1800's Harvard Classic books I love and cherished in storage. I cannot be around them. I promised him I would read them.

WHILE LIVING IN MY HIGHER STANDARD OF LIVING.

I have 3+ years of water leak problems documented with foundation problems; and of warped ceiling floor boards they would not offer to fix for 2 years after my move in. Then offered to fix the ceiling two years later if I would sign another lease first: before fixing. (I have all this documented in their letters).

I would not sign a new lease because of the problems and was punished; I had to pay extra rent for a month to month lease. Still on month to month paying $1,395.00 a month, they would not fix the ceiling. By using the ceiling and making me pay a higher rent as leverage to get me to sign a new lease. I knew if I signed the lease they would never fix it and I would continue to be stuck..

When they relocated me with all my contaminated furniture. IAC finally got around to fixing something after I complained of water problems for 3.5 years in the first moldy apartment that made my blood counts, platelets drop.(all below under health). Management finally decided to fix the water leak in the bathroom when it started coming above the floor. This water appears to have been going under the floor board to my walk in closet for a long time. I complained of damp carpet in the closet and turning orangist 1.5 years prior. But of course they threw it back on me stating: "quit putting on your perfume in the closet" and it did not feel wet enough and I had too much stuff to move.

I complained of dripping noise and smelly carpeting in the dinning and living room areas from the day I moved in. However, they would not check it. Just mentioned they did not hear anything and the carpet did not feel wet enough to them, they of course refused to smell it. They did send out carpet cleaners on 2 different occasions to try and get the smell out.

There was a work order turned up they were aware of foundation problems and never fixed them.

Why I did not get my own environmental report before I was moved

They opened up the wall in the bathroom because of the water leak coming above the floor. My closet was now saturated with water.

They pulled up and out the carpet in my walk in closet. That week the Rancho San Joaquin Management said an environmental person was to come out on that Friday and they hired movers for me to move on Sunday. I was not allowed to live on the property I was currently living, I had to go live on another one of their properties. In addition, they were shipping my clothes out to be decontaminated at their Fosbergs Cleaners in Long Beach. They sent all mold victims clothes there from what the Manager told me.

Friday came at 4p and the environmental person did not show. I went down to the office to see why the person did not show and the Maintenance Manger said the environmental person cancelled. I was bamboozled big time and did'nt undedrstand until later. Sunday came and I had to move or they would not fix the plumbing. Management said I would get a copy of the environmental report after I moved. I feel so stupid for trusting them.

I was pretty sick and did not catch on to the apartment as the culprit and what they were trying so desperately to cover up.

Rancho San Joaquin Apartment Mangers promised to reimburse me for my moving expenses if I moved quickly. Having a business in my home and networked computers that came to about an additional $4,000.00. They paid the moving company directly of course, wanted to make sure I was out fast, I guess. The Manager said she was going on vacation and did not want to be bothered with this on her vacation time. She wanted me out before than. However, she stopped in to follow up at the end of the day (day off). I showed her all the mold under my file cabinet after their movers moved it. We touched it; and black, very sticky, like tootsie roll. Expenses added up; I had to change my business line...38 mail contacts. I still have not seen my moving expenses I was to be reimbursed because...

To get the moving expenses reimbursed, I had to release any and all responsibility to 'water intrusion' to them forever. 'Water Intrusion' appears by law to include mold. They promised me my 'moving expenses' if I moved quickly. At that time there was no mentioned of 'water intrusion release'.

By now the neighbors had called me. I went back to my apartment and saw the contamination sign. I saw the clean air machines in my apartment the day after I moved out. I would not sign the release titled 'Moving Expenses' which mentioned in it 'Water Intrusion' in order to get my moving expenses reimbursed.

Linda Burden of Smith and Susson called me yelling at the top of her lungs on the phone, threatening to drag me through litigation for years. I had to hang up on her. Both Lady Attorneys have a habit of gong into complete cyco, nasty, yelling fits while trying to get people to do what they want. They are out of control and threaten people. I have no idea why the Irvine Company would allow these so called highly intelligent professionals who are to be officers of the court to represent them in this way. I guess they have so much to cover up they can't win a case with smart, professional, honest, ethical Attorneys.

THEY LIED TO THE TENANTS and slandered me.

I was moved out with only a four day notice the Management tried to cover up the mold. Turned out many apartments had mold there. They told the neighbors there was no mold in my apartment and I heard they called me names. Now appears they are claiming mold (because they have to, so much was finally uncovered as time went by), but now stating I I did not suffer health problems.

They did not realize someone had left the abatement company sign stating "entire unit under containment" on the door with all the Local Union 882 workers sign in names on it. Or that neighbors were watching very closing as to what was going on in my apartment. That the neighbors contacted me to tell me what was going on.

I went back to the apartment a few times. I was horrified at what I saw going on in there. Guys in white suites, walls opened up. Black all through the walls, contamination sign on my apartment all boarded up. Clean air machines...When I told the workers I use to live there they were shocked and asked me how long...

At this time I was sent to an Oncologist because of my blood counts and scared to death. The Dr. was getting ready to do a bone marrow biopsy. I told the Oncologist form Hoag Cancer Center my apartment was boarded up with a contamination sign. He mentioned the bone marrow biopsies are painful and asked if I wanted to wait about 30 days. After 30 days out of the apartment I went back to the Oncologist and my blood counts started to get better. So I did not have to do the biopsy. But he follows me every three months for blood work and bone marrow since. I have been out of the toxic mold apartment for 3 years my blood counts have become stronger and stronger.

Right after I moved out; my main focus was the blood problems and trying to find my jewelry, I kept thinking it would turn up. I had so much stuff to move. They hired 4 movers which took 12 hours to move me. One got drunk on the job. Then at the end of the day, 8p at night, the movers just left everything in the middle of the living room in the apartment I was relocated to. I was left with a huge mess with no help. The cleaners brought my decontaminated clothes to my new apartment.

I still did not get that the apartment had made me sick until my body changed to 180 and I started to detox.

She lived in my old apartment for 6 months and started to complain saying she and her cat were sick... She mentioned IAC Manager and Asset Environmental owner came by to talk to her and gave her only the 'closure report'. (showing no mold problems of course, very sneaky people wouldn't you say!). They also stated I was ____ and there was no mold.

The nest tenant showed me the report. On that report was the lab (not the air sampling company). We called the lab itself in Virginia and received the other reports that were done before the closure report. This showed mold and showed Irvine Company and their Attorneys will lie till there blue in the face.

IAC had 3 environmental reports on my apartment. However, they told my Attorneys and myself, they did none. Told the tenants there was no mold. Lied, covered up. They would have never gone through all this if it were not bad.

They clean the mold, test the air, then if not clean, clean again, do a report...and keep doing this until the air tests show clean air. The last sample of clean air is apparently called "closure report". The 3 reports done by IAC on my Rancho San Joaquin apartment showed levels lowered as they came back and re-cleaned. However, the mold removal records show they started to clean the apartment before the first report was done. Unless there is still a missing report.

I've heard the air tests may not be accurate if they test right after the chemical machines are run.

The apartment had already been professionally abated with all new walls appliances etc. $15,000.00 of work done before the next tenant moved in. I have all the abatement records and mold removal invoices. The mold came back or was not cleaned properly. I think it spread to other units. They did not advise the surrounding tenants and check the surrounding units. However, the abatement company statements tell the Management company to "advise the tenants or the presence of fungal growth in their units."

The next tenant called me to say she had toxic mold and they were moving her out. (I kept the recording) They took pictures when they opened up her walls and the mold had grown back extensively in the bathroom. I have those pictures, lots of them with the removal of her new carpet etc. The whole building was then relocated from mold problems a year after IAC moved me. However, they had each other and an Attorney had just moved in to an upstairs unit in the building. The tenant after me knew how to handle it and had her own environmental testing done. She contacted my Attorneys with a letter about what was going on.

DEFENSES COVER UP OF THE ENVIRONMENAL REPORT (S).

Ms. Burden of Smith and Susson Law Firm, did not want to produce the environmental reports and stated in a specific letter to the Attorneys:

Dated: December 20, 2002

"We do not have any environmental reports, air sampling reports, or lab reports to produce with respect to plaintiffs request. It you not be normal operating procedure to obtain pre-remediation testing unless it were requested for a specific reason, such as at a doctor's request."

No environmental reports submitted to date by the Defense Attorneys. I doubt they ever plan on releasing any, even by subpoena (which they quashed when I tried). However, abatement records stated through out when air testing was done.

ANOTHER IAC APARTMENT HOME - Anything they could do to me.

I was assured by the Manger when I moved in to Newport Bluffs, I would not receive the same treatment I did at Rancho San Joaquin - they lied again.

Newport Bluff s is the other IAC apartment I moved into after the first bad toxic mold exposure. The bran new apartment had ventilation system problems. The system did not work at all when I moved in so they 'purged' it. The system runs off the hot water heater located on the patio. There is no intake or outtake. You have to open up your front door for air. I complained about black splintery specks flying out into the air and all over the white counter tile, after they 'purged' the water that had gathered in the unit located in the ceiling of the closet.

After what I had been through granted I wanted this checked. I was diagnosed with Bronchial asthma after the toxic mold apartment.

They 'purged' the water with a garden hose stretching into the toilet. Maintenance taking a hose and running into the toilet to release this dirty water from the internal system. What came out was like black wet dryer lint and dirty water. It was disgusting. I was told they do that all the time. Then after starting the heater, black sliver specks flew out and I had terrible headaches, anyone who came to may apartment got headaches.

I was told by the Maintenance Manager "they had a meeting at the Irvine Company and he was not allowed to help me" or clean the vent systems for me. So I sat in my new Apartment Home with the front door open. I had just bought a new bed and had all my clothes dry cleaned again from the first IAC mold apartment.

I finally mentioned I was doing an environmental report and then Irvine Company finally sent a letter stating "they did not want anything to affect my health and an environmental person was going to come by and test." They did not care about my health until I had my own testing done. You could not pay me enough to do this to people; I would not be able to sleep at night. I kept the windows closed while their report was done and ran the ventilation system as though a normal person living in the apt. (if you have environmental testing done, keep the windows closed for 24 hours. I did not know this) I stayed outside.

I wanted a copy of their report. However, Pacific Health a Safety who performed the air sampling wrote a letter stating Ms. Linda Burden or Smith and Susson Law Firm would not let them release the report to me. My report showed toxic mold in that bran new apartment no one had lived in before in the kitchen area. I had my apartment open all day with out the ventilation system running when I did my report. I don't have any clue why I could not get a copy of their report to see what was going on.

So I stopped paying rent. They gave me a 3 day notice to vacate and I was unable to get another apartment, they gave me a bad reference. I still have not received my deposit back.

I was left to live in a hotel, which cost me a fortune. At this time I had spotless credit and my savings was dwindling from the below of what they has already put me through.

I was sick with fatigue off and on...sometimes in bed for 3 weeks, Afternoons were the worst from 11-12p to 6-7p, you sleep a lot, especially during the spring and summer. Winter you have more energy starting around October. Evenings I would get out and walk or go have dinner. Sometimes you think your Okay that day, go to the store or out somewhere and right in the middle of what your doing your body crashes as though 1000 lb waits are on you. You have to leave and go home to bed and sometimes just hoped I could make it to the car. Sometimes put my head back, in my car, in the parking lot, after out somewhere and took a nap.

The hotel cost me a lot and I had to start living on credit. I started taking a ton of supplements (this cost a fortune about $400.00-$500.00 a month, B's, Iron...Noni Juice, and juicing green leafy vegetables, I think this helped make my blood stronger. That along with tons of caffeine helped me get by.

Forensic Toxicologist recommended vitamins to help get me through the day, detox my system. If I stopped taking, would end up in bed for 15+ hours a day.

This is the worst part of the losses: Management and workers pulled out everything in my closet. They had my clothes and luggage shipped out to be "decontaminated" as their cleaners put it; at the last minute when I was given a four day notice to move. They used on a continual basis Fosberg's Cleaners in Long Beach...The Manager said IAC was big account of there's. Then they paid four movers to come and get me out quickly.

My grandmothers and great grandmothers jewelry was in my closet. My Grandfather's solid gold watch (even the inner workings of the watch were solid gold) presented to him during his retirement, after years of service as a Naval Aerospace Commanding Engineer was stashed in my closet. I gave my Grandfather a fake ruby and diamond cuff links when I was really small, and he kept them always. They were kinda gaudy, but he wore them proudly. After he passed, I wanted to keep them. I even would wear them myself. I Guess someone thought they were real, they were worth a lot of memories to me, only to find they are gone and never found again. I kept going back to the apartment to see if they would turn up after I moved out.

Their money can't replace this and all they have put me through. These people have hearts of stone and will lie and cheat with out a care in the world.

I take it back, they are scum and not just their tactics. I am finding more and more Attorneys who say they could never perform in the manner Ms. Lutz and Ms. Burden do. Their reputation I am finding out is becoming that of disgust in the Orange County community by their own peers.

HEALTH SYMPTOMS

You never had these problems before. You had a great life. You were always on the go, having fun, working in a career you loved, and making money that would have bought you your first home

A "Spect scan" at UCLA showed right side brain damage, toxicity. I don't believe they have this equipment anywhere else. In the waiting room I met people from all over the country who flew in. Some with children who were having problems. I believe the toxicity takes over the oxygen in your brain...something like this (check on it).

Forensic Toxicologist's are aware of "Spect Scans". My regular Dr.s did not.

So powerful it makes your blood platelets, red and white counts drop, contaminating your blood which travels through your heart, liver, brain, intestines, bone marrow, eyes...causing Sinsus Tachycardia (chest wall pain), loss of vision, bronchial asthma, Legionella Pneumophila (detect with a blood test), Immune System problems signs of Lupus but not Lupus (ANA is the lab test that detects this). Liver count goes up causing black floaters in your eyes, you get bifocals, arthritis, brain fog, in ability to stand motion and fly, brittleness and moons of your nails go away, toe nails brake off and do not grow back until a year + after moving out, ABS (colon closed up), several ER visits for heart problems, fatigue, bloating.

FYI: I found a great gasro Dr just last year. He prescribed Murolax, which helped the ABS a lot. I blew through a few gastro Dr.s and finally found one who got it. I think this helped me get the stuff out of me to detox quicker.
 

So powerful, you turn yellow, wake up and small amounts of blood has dripped out of your ear on to your white pillowcase. When you use a q-tip to clean your ears its blood stained. Bloody nose creating cysts...night sweats and fevers.

Your legs bruise easy (see picture). Sore throats...chronic fatigue. When you take a breath in your 'Apartment Home' it's impossible to breath deep with out a sharp stabbing pain in your chest. You try and keep up your work out schedule in which you use to work out 2 hours almost every day and then you start to get black outs and dizzy where your sight goes black for seconds and comes back. The whole time I thought it was my heart.

I was cold to the bone even in 90 degree summer weather and would take hot baths to warm up.

2 years ago I had a couple nodules growing on my thyroid. Now I have more.

I kept running form Dr. to Dr. with heart problems, getting blood tests in which my CBC counts dropped. Hoag ER for chest pain breathing.

You think it's your heart; you run to cardiologist after cardiologist. All they find is a heart murmur, you never had before. My heart rate would jump up to a point when out of the apartment I had to go to ER and actually have IV medication to slow it down. In the apartment had extreme fatigue, out of the apartment away from the toxins your heart rate triggers and jumps up. A lot of heart palpitations too where I could see my shirt move when it was going off.

You feel as though you're in the movies when the character is paralyzed but alive. You want to scream to your doctors...help me, there's something wrong, I just don't feel right. Dr. asks you if your sleeping OK, you say sure...I did not get in there face like I should have.

No one has checked you for toxic mold and they most likely never will, unless you know enough to send your self to experts, which by the way don't take insurance.

I'll never forget the day I started to fall asleep at the wheel of my new 740 BMW on the highway. As I was just about to doze off on a Sunday afternoon doing 65-70 MPH, I went under an over pass with my sun roof open. Thank God, I heard the swoosh of the wind from the over pass through the sun roof and jerked awake with only a couple more miles too get home. Went home and slept until the next day. I never slept in mid day before and certainly not for 17 hours. I never fell asleep while driving a short distance after already sleeping 12 hours the night before.

It's as though you're given (1) poison pill a day for the first year, then 2 a day the second year, then 3 a day for the third year until there are times you can't speak properly, function with multi-tasks. Your neighbor across the hall keeps knocking on your door saying you left your keys in the lock all night. Ever driven off with the gas hose still in the tank on several occasions. I didn't before I moved into a "higher standard of living".

You don't know when you're slowly being poisoned to death. You go about your daily life, trying to get through the day. You get sicker and sicker, drink more and more caffeine to get through the day (I never drank caffeine before, I was full of natural energy). With toxins in your brain you just don't get it. You're so tired. I worked from home. In the end to get through a workday, and be able to get to a Dr. was a big task. You let things go, little, by little; the smallest task seems to take forever. Some days towards the end I could not mouth words.

If you live alone it's harder to figure out. A family might be able to see the signs sooner when the whole family starts to experience the same symptoms.

After 6 months: I became fatigued and getting by on caffeine.

After 1 year: In Hoag ER for heart problems...pulmonary, sinus tachycardia.

After 1.5 years: falling asleep driving, left my keys in the door, groceries on the counter, water was left running in the sink after washing my hands. Regarding my blood counts: My Platelets, red, white counts dropped. I had chest pains when breathing. Hoag ER, room, heart problems, turned yellow, night sweats, loosing eyelashes, trouble speaking, movement problems, unable to ski with out loosing my balance, unable to fly in planes, drive my car over 60, traveling into the mountains dizzy, brain fog, black; eyes sight would go black and come back, lose of eye sight and where byfocls, running water nose, soar throats, blood coming out of my right ear and nose, moons in my nails went away, bronchial asthma, fevers while in the apartment, ABS, Lose of toe nails on the right foot, arthritis, right side brain headaches. It goes on...

I did not have these problems before moving into my apartment home.

After I moved and was out of the mold apartment for (3) weeks

My body went through hell. As though someone had taken a drug away. I could not keep food down and when I brushed my teeth in the morning would gag. My blood CBC platelets counts were getting better. I only slept 1-2 hours at a time and not fatigued anymore. My legs and feet cramped up constantly for 6 months after I moved out, the pain was terrible. My heart was completely out of control. I felt like I was going nuts. My energy just flew through the roof until spring again. My body went from one extreme to the other. Complete detox of micotoxins. I did not have blood coming out of my ear anymore. I did not spit out blood in the morning. I did not have night sweats anymore. The headaches though were horrific as though someone had a clamp on my head and my head was trying to bust out.

Spring came and black shiners came, fatigue again, which I went through 2 extreme seasons like this, until this year and getting better with moons in my nails coming back.

About 2 months after I moved out I heard about 'Micotoxin' blood testing and learned about IGA, IGG, IGM levels, and went to see a Forensic Toxicologist who did the testing. My apartment was very wet.

3 years after moving out: No more bloody ear, or spiting out blood in the morning. Moons in my nails coming back, fatigue varies 40-60% better and only worse on damp days or when I move my clothes. Followed by an Oncologist every three month; IGA goes up when live close to the beach and down when move inland (bone marrow). Liver count goes up and black floater in my eyes when I wear my winter clothes. Followed by Pulmonary Dr. diagnosed with Bronchial asthma which triggers depending on weather etc... Gastro Dr. for ABS. Speck scan shows right side problems, same side as blood came out of ear. Right hand trouble moving when I first get up. Still get confused. However, not as forgetful. Haven't driven off with the gas hose in the car. Don't leave the groceries on the counter. Brain fog gone. Eye sight clears when in Big Bear and can breath. Not dizzy when going up the mountain. However, trouble on skis.

I'm starting to get better at forming correct sentences. Before, I was a mess.

HOW I FOUND OUT ABOUT MY BANKRUPTCY NOT CLAIMED AS AN ASSET

I drove all the way out to Fresno to a legal Malpractice Attorney who said he would look through my whole file for free. Mold Attorneys I sent my file to would not tell me why they were referring me to legal malpractice attorneys, not mold. I would send the BK papers with my file. Legal Malpractice Attorney's didn't know why I was contacting them. It was 3 solid months of nightmare run around.

The nice Fresno Legal Malpractice Attorney found out I did not own my case after he spent hours looking through my file with me, taking notes (he was great). He showed me in the legal books where the penalty for not claiming my case as an asset during a bankruptcy was 5 years in prison. I started crying right there (I had been through so much), he even started to cry. I think he felt so bad after everything I went through. By the time he figured it out he had taken extensive notes and spent about 3 hours plus with me. He knew everything I had been through.

I drove all the way back form Fresno at 10p at night. I cried for 3 days straight until the whites of my eyes turned blood red over all the mess and my life just destroyed. I'll never forget looking in the mirror and seeing blood red, almost swollen shut eyes and no whites to my eyes. I was horrified and thought I should run to ER or something, but if I wasted time could be sent to prison.

Then I had to get up and fix my case so I would not go to prison. I had to fix my case before 6 months after the bankruptcy release (something like this) and had 3 weeks left to tell the judge and find a BK Attorney that would help me. No BK Attorney wanted any part of this mess. Especially when I told them the Irvine Company was involved. I made 100's of calls begging for help. I was on the phone day and night. Mentally exhausted.

I had to find a bankruptcy Attorney and re-open my bankruptcy until the bankruptcy trustee released the case back to me, which took 7 months.

A 'Toxic Mold' attorney could not legally take my case until it was released back to me. The Trustee owned my case at this point.

I found a BK Attorney in Long Beach. He made some calls and took care of everything. But it took a while and all those months I was stuck in pro-per against 3 of the nastiest people I have every met in my life.

After the Micotoxin Toxic Mold Health experience, you will never be the same. Your body's like a barometer. Barometric cluster headaches that when the summer turns to winter Santa Ana's will have you in bed and dizzy, even 3 years after you move out. My energy level after 3 years is just coming back. The moons in my nails were starting to appear this year.

My body is like a mold divining rod now. If there is mold in a building I can detect almost instantly and become dizzy. Difficult to be in a room with the ventilation system running, eye lashes will fall out, fresh paint makes my tong swell now, new carpeting makes my nose bleed and my legs break into bleeding pin hole rashes. Winter turns to summer and I get other pin hole marks on my body. I thought it was the chicken pox until it happened each year during the same weather transition when winter turned to spring around April, May.

I started back to work for a short term contract after 2 years of sick and unemployed (I am a contract recruiter, love to offer people jobs). I use to recruit Semiconductors. Luckily, this was an easy contract with all the same sales people positions to fill. It helped get my brain working again. At first was under a ventilation system in the middle of a large enclosed room with lots of cubicles and realized my body was not handling it well and barely making it through the day and almost had to quit. This was when I realized not only the mold was a concern; I am chemical sensitive now as well now. My face and eyes would swell; my legs broke into rashes and bled. I wore socks and covered my legs with oil to keep from itching and bleeding.

Luckily, I saw an empty cubical in a smaller area near a door at the end of the building and used an excuse to be moved to that area and hoping that would help. Luckily, too they were in a fairly new office with clean ventilation systems. Some of the IT guys knew I was having trouble and found extra ceiling tiles to cover the vents above my desk where my boss was kind enough to relocate me. I took a clean air machine to work, I was then in a separate smaller area. All this helped me get back to work. Just a couple people laughed and made comments. Others with allergies were glad and brought machines of their own to work. We created a pretty good clean working environment and they kept me on for an 11 month contract until a hiring freeze and acquisition.

Most of the people in this company were really nice, kind hearted, good, people. My boss was hands off and I felt lucky to have this as my first company back when still not feeling well. Until this time I did not know my body would be sensitive to chemicals as well. That boss will have no idea how much she helped me and how happy I was to get back to a career I loved and back to work on an easy contract with nice people to work with.

THEN FOUND OUT ABOUT THE BANKRUPTCY and the ATTORNEY DROPPED MY CASE 30 DAYS BEFORE TRAIL. I FOUND OUT HE DID NOT ATTEND MY DR. DEPOSTIONS, ALL MY DEPOSTIONS WERE CANCELLED and it was worse in pro-per.

MY WATER FILLED 2nd no paying job EXPERIENCE

The vision: smile, stab, smile, stab, smile, stab...sure seems to sum up the way I was treated at the "higher standard of living" level in my apartment home. Which you can see by the pictures I actually tried to make it my beautiful home and furnish it accordingly. I figure by now with their rental increases I would be paying 1,700.00 a month and still hear "nope carpet does not feel wet enough to me."

I hear a slow drip in the wall while working in my home office: drip - splat, drip - splat about every 20-30-60 minutes, very slow. My walk in closet carpeting feels damp and is turning an orange color. My carpeting smells like sewage in spots while siting on the living floor doing my yoga from the very first day I moved in. My apartment in no way or form looked like the model I was shown. The model apartment did not have rust stains on the carpet, old appliances, ants, warped baseboards and warped, purple spotted linoleum or foundation leaks.

Water is poring in from upstairs when it rains and the carpet is coming apart at the seams. The ceiling boards squeak loud as if warped when walked on by the upstairs tenant who was a trim lighter weight woman (who mentioned she moved upstairs to get out of the lower unit and the Management was aware of all the problems). When the tenants up stairs flush their toilets it sounds like a flood of water fall coming through my bath room and disgusting. My linoleum in the bathroom had purple lavender spots under it and the base boards are warped and the paint is peeling off...

The tenant prior to me was a VP of IT and stated he put in work orders to get water leaks fixed that were never acknowledged.

Two previous tenants complained of water problems and ceiling floor boards that were never fixed. I did not know this until after I moved in and they came by to see me. One girl a VP of a bank moved upstairs to get away from it. The VP - IT who moved in after her moved down the street.

You see the leasing team acts like you're the only one with a problem. They will deny till they are blue in the face that water problems, toxic mold, any problems, ever existing in your prospective "new apartment home."

So you don't have to move again after just getting settled in and back to work; you call, write, complain, and think why in the heck do I have to police their work, get them to acknowledge a problem, why can't they just fix it. What is all the advertising they state "higher standard of living," "Apartment Home." They were so nice before I signed the lease.

It's like a 2nd job trying to maintain your apartment home with the extensive politics and same continued complaints not fixed. letters back and forth to the leasing office trying to get some action. They don't answer most of the letters and you make personal visits. You are exhausted and have a life. You give up and figure they know what they're doing. However, your apartment home is making you sicker and sicker and you don't even know it. You have stuff to move, a new place to find. What another hassle, you just moved. All because your "higher standard of living" has you warn out. Why should you have to move and pay the cost because they don't want to fix things or "don't have it in the budget." However, they are building 5 more complexes of over 5,000 units each.

Do you have any idea how many people have no idea their apartment owners are to provide them a safe living environment. I didn't. Do you have any idea how many people never know until they move out of a contaminated apartment and see there body change that they had no idea their apartment was making them sick.

After I moved out and spoke with previous Irvine Company Maintenance Managers, I was told all work had to be approved at the Executive level. Therefore, can't there be one big class action. All the complexes owned by the same company, managed by the same company and, most likely built by the same builder?

Per the highly experienced leasing team of my "apartment home," we can't show you the apartment until you sign the lease. Your apartment "will look just like the model we showed you." We don't have time to run tenants around showing apartments; I can't leave the leasing office. I heard from a floater who previously worked for IAC for a couple of days. She now works for Shay and loves it. However, at Newport Ridge apartments they did not want to show prospective tenants apartments and had her doing it. This was on her first day as a temp floater, who never leased before, she was to show them a model of some sort only.

The actions sure don't match the advertising. This is why I have punitive damages.

Per the Rancho San Joaquin highly qualified maintenance team when I complained of damp and orange-ish carpet...quit putting on your perfume in the closet, the carpet is damp because you're on the first floor, and we're not fixing the ceiling until after you sign another lease. I don't hear a drip behind the wall and you have too much stuff to move, I don't have the time. No I'm not going to take off my shoes and feel the damp carpet or smell it. It is not in our budget to get you new base boards; I could never get it approved. We will pull up the linoleum and now we have to Lysol under it from the stench so please leave your apartment. We will give you paint and you can paint over the baseboards; this is what we do with the other tenants.

People move out from around me every 6 months or so. They told me it was because of maintenance issues.

Their highly experienced team turned out to be highly experienced at BS and throwing it back on me. All you think is; if I move I just deal with this attitude at another one of their complexes. They own just about everything in that area.

Developing a training program on how to accommodate the customer's needs (and less attitude) appears to be something Bruce Ensley, Vice President of Human Resources has neglected to do. In fact during a dinner conversation we had and I brought up complaints from the tenants...around me earlier in my move in. His direct comment was "people like to sue us because we are a big company." He seemed extremely disturbed HUD was making Irvine Company offer affordable housing.

We will re-clean the rust stained carpets from the previous tenant. Rust stains were from their foundation leaks. However, you can't have new ones. This was when the neighbors said I had to speak up in the in the leasing office in front of prospective tenants they were trying to lease to in order to get clean carpet just like the model I was promised. Saying in front of them; you can't get out rust stains in carpet, they were already cleaned once. My apartment was to look just like the model. Finally, I received some action and they replaced the carpet, but not the black stained damp padding.

- leave the water running, I Don't fall asleep in my car anymore. My toe nails have come back. Fingernails are stronger. Skin isn't yellow anymore.

Strange, how you can move into a "higher standard of living," "apartment home," and over a period of 3.5 years get sicker and sicker while living there. Then, move out and over a period of 3 years get better.

I just didn't know. I did not see the signs. I thought mold was green and slimy. My Mom and Dad always kept our mid-west house in top beautiful condition when I was growing up.

I have allergic reactions now, I can't be around a ventilation system; my face swells, hair and eye lashes pop out, my hands hurt. I freeze in winter, and hot in summer. Perfume makes my hair pop out. New paint smell makes my tong swell and as soon as I leave the room with in an hour goes back to normal. When I sit on new carpet or new office cubicles...my legs break into bleeding pin hole rashes.

I'm not a multi-taker anymore. Takes me a little longer to accomplish a task. After everything I don't trust people anymore. The last part of the years I had left to have a child are gone.

ARTMENT VENTALATION SYSTEMS

Does your heating and cooling system run off the hot water heater located on the patio and the air only circulate within your apartment? No intake or out take, no cross ventilation unless you open up your front door. Did you start to loose a lot of hair and get headaches after you moved into your apartment. When you take a shower, you can't run the heating system or no hot water. Do you think the moisture is accumulating in the heating and cooling system and forming mold?

WHEN LEASING YOUR APARTMENT

What does the leasing person say to you when trying to sell you a year long lease (or now its 13 months plus your going to be stuck there) "Look at the nice tile and new appliances, your apartment will look just like the model." Personally the one that cracks me up is the so called walk in closets you step into it and there's 2 rods. However, by not building an apartment big enough to hold a person's regular belongings you then have to lease an expensive storage space also owned by the same company? They own the Mini U Storages.

What does the highly experience leasing person say or do when you ask specific safety questions about the apartment regarding the ventilation system and how it operates, to have the vents checked inside for safety and mold. Ask them to see if the heating units need to be 'purged' and full of water. Watch the highly experienced leasing person's face.

Does the vent system look brown around the outside or on the grill?

What does the leasing person say to you when you look through the apartment checking under the sinks for water leaks? Wonder what the leasing person would say when you asked to see the work order history on the apartment? Take a moisture meter with you and check the walls for internal water leaks / intrusion. Try this important apartment safety check and mostly likely you will get a big laugh as you see the highly experienced leasing person totally flip out.

But, you won't do all this for fear they won't lease to you or the "higher standard of living" will raise your rent. They don't have to tell you anything about the apartment.

Does the lease state: "If you see mold, report it"? Go ahead, report it, and then see what happens. It'll be the first call your leasing Managers make to their Attorneys.

This is not the mold that forms from the wet shower that you can clean yourself. I'm talking about the mold that forms in the walls and ceilings. The mold from poor plumbing and cheap building materials. The mold under the bath toilet floor boards (like someone else I met) and grows from apartment to apartment spreading like a wick in the walls that you never see but puts off toxins. The mold that forms in the carpet padding from foundation leaks caused by a huge tree located right out side your apartment in which the roots have uplifted the patio cement and obviously have grown towards your apartment (me). The mold that forms poisonous 'Mycotoxins' that get into your blood and lowers your CBC counts causing bone marrow problems. The mold I am talking about is the mold that prevents you from functioning at work or school. Not the patch you see between bathroom cleaning. But then that could be a sign of moisture inside the wall????

If you don't check the apartment for mold safety yourself, for the rest of your life you're going to pay for their neglect.

Go a head and ask the questions regarding the safety of the piping and ventilation systems of the apartment. Does the highly experienced leasing person give you a political "we have never had any problems before, I am not aware of any mold" (don't believe them) and then the conversation is ended with a political sale or wanting you to exit the 'apartment home'.

OTHERS I SPOKE TO THIS YEAR AFTER FET UP and FOUND I WAS NOT THE ONLY ONE.

I heard from a college student, Biology major, who lived in Villa Sienna Apartments. He mentioned his roommate came down with spinal meningitis twice in one year. He stated; he opened up the wall and found black mold. Closed it up.

A Director who lived in Baywood Apartments could not fly any more form the neglect of the Irvine Apartment Communities. she had her pilots license. She did not know how to protect herself either. Others I know of, with Plaintiff Attorney's are beaten down because the little Plaintiff Attorney does not find it worth fighting for (1) little apartment mold victim. Or, like me, I did not know I needed my own environmental report as well. I think with all my health problems documented all at once after moving in, If I had a report, I could have found a big law firm to help me because I had lots of labs done and ER visits. Who knows. Even my last nice sick Attorney said they were spending a lot of money on experts and he did not know if he could afford it.

Others, who became really sick and did not cover their tooshes with an environmental report of their own tried to fight. I heard it didn't turn out well. Some I met were stuck and did not try to fight because they did not have ANY documentation. I had lots of documentation, but not my own environmental report. Their Health Insurance had to pay for this company's neglect. One family with a new baby was the saddest story, the child has severe lung problems. I spoke with the Dad and Mom. The mold was in the babies room. They stated: IAC Management came out and sprayed the mold around the ventilation system in the babies room. This made the toxic mold air born and then said it would be fine. No other clean up was done. No highly experienced Maintenance Manager looked to see where it was growing form. They did not know to get an environmental report of there own and of course now very upset they did not get a report before moved.

(2) other women I spoke to were moved by IAC from one mold apartment to another mold apartment. They were left to rot in their 2nd units with no help. One had a small child in school who became sicker and sicker in the 2nd apartment which she stated was worse then the first. She wrote, called, yelled and screamed for help. Unfortunately, they signed the 'water intrusion release' after IAC moved them in order to get their 'moving expenses' reimbursed. However, IAC calls it "Moving Release". (I would not sign and mention below). This releases IAC from further claims regarding the next mold apartment the tenants were moved into, and any mold apartment you should be stuck with ever if you continue to rent from them.

I found out that Forensic Analytical Labs have many reports of mold testing performed on IAC apartments. They are either under the apartment complex name or street name and number. These should be available to the public.

See Irvine World News "Renters Crying foul play," See "Irvine Ordinances to maintain the exteriors of apartments." What about the poor interior Maintenance issues that can make you sick. See "Irvine Renters task force." IAC makes everything look pretty, but your not safe. Some apartments which are already making people sick are under 10 years old. I wonder what it's going to be like in 5-10 years.

Fix any moisture problems in your home:

  • Stop all water leaks first.
  • Repair leaking roofs and plumbing fixtures.
  • Ventilate and insulate attic and crawl spaces.

  • Increase air circulation within your home, especially along the inside of exterior walls, and ventilate with fresh air from outside.
  • Provide warm air to all areas of the home.
  • Move large objects away from the inside of exterior walls just a few inches to provide good air circulation.
  • Install and use exhaust fans in bathrooms, kitchens, and laundry rooms.

  • Vacuum and clean your home regularly.

  • Clean and dry water damaged carpets, clothing, bedding, upholstered furniture within 24 to 48 hours, or consider removing and replacing damaged furnishings.
